Terms of service

Welcome to Cutz Mapz ("we," "us," or "the platform"). Cutz Mapz is a barber discovery platform operated at cutzmapz.com that connects customers with barbers through a live, interactive map. Barbers subscribe to monthly map slots to be discoverable, and customers use the platform to find barbers, book appointments, leave reviews, send direct messages, and process payments.

By accessing or using Cutz Mapz, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the platform.

You must be at least 18 years of age to create an account or use Cutz Mapz. By registering, you represent and warrant that you are at least 18 years old, that all information you provide is accurate, current, and complete, and that you have the legal capacity to enter into these Terms.

We reserve the right to request verification of your age or identity at any time and to suspend or terminate accounts that do not meet eligibility requirements.

You may register for a Cutz Mapz account using Google sign-in, Square authentication, or email with a verification code sent via SMS or email (powered by Twilio). Each individual may maintain only one account. Creating multiple accounts to circumvent restrictions, manipulate reviews, or abuse platform features is strictly prohibited.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. Cutz Mapz is not liable for any loss or damage arising from your failure to safeguard your account.

Membership and billing. Barbers may subscribe to a paid membership plan to appear on the Cutz Mapz map. Membership fees are billed monthly on a recurring basis and processed through Square. Your subscription automatically renews each billing cycle unless you cancel before the renewal date. All fees are non-refundable unless otherwise stated.

Map slot availability. A paid membership does not guarantee a specific placement, visibility, or position on the map. Map slot availability and display may vary based on geographic density, customer location, and platform algorithms.

Independent contractor status. Barbers on Cutz Mapz are independent contractors and are not employees, agents, or representatives of Cutz Mapz. You are solely responsible for the quality, safety, pricing, and legality of the services you provide. Cutz Mapz does not supervise, direct, or control barber services in any way.

Barber obligations. You must maintain an active Square account connected to your Cutz Mapz profile to receive customer payments. You are responsible for complying with all applicable local, state, and federal laws, including licensing requirements, health and safety regulations, and tax obligations.

Cancellation. You may cancel your membership at any time through your account settings. Cancellation takes effect at the end of your current billing period. Upon cancellation, your map slot will be removed and your profile will no longer appear in customer searches.

Customer accounts are free to create and use. As a customer, you may browse barber profiles, book appointments, leave reviews, and communicate with barbers via direct messages.

Reviews. All reviews must be honest, based on genuine experiences, and free from defamatory, abusive, or misleading content. We reserve the right to remove reviews that violate these standards.

Payment information. Customer payment information is securely tokenized and stored by Square. Cutz Mapz never stores your credit card numbers, CVVs, or full card details on our servers. By saving your payment information, you authorize Square to process payments on your behalf for bookings made through the platform.

When using Cutz Mapz, you agree not to:

• Post spam, unsolicited promotions, or repetitive content
• Submit fake, misleading, or fraudulent reviews or ratings
• Harass, threaten, bully, or intimidate other users
• Impersonate another person, barber, or business
• Scrape, crawl, or use automated tools to extract data from the platform
• Attempt to gain unauthorized access to other users' accounts or platform systems
• Use the platform for any illegal purpose or in violation of any applicable laws
• Interfere with or disrupt the operation of the platform or its infrastructure
• Upload malicious code, viruses, or harmful software

Violation of these rules may result in content removal, account suspension, or permanent termination at our sole discretion.

Barber membership fees. Barbers pay a recurring monthly fee for their map slot subscription. Fees are processed through Square and are subject to change with reasonable advance notice.

Customer-to-barber payments. Payments between customers and barbers for services are processed through Square. Cutz Mapz facilitates the payment flow but is not a party to the transaction between the customer and barber.

Refunds and disputes.Refunds for services rendered are handled directly between the barber and the customer, or through Square's dispute resolution process. Cutz Mapz is not responsible for issuing refunds for barber services and does not mediate payment disputes between users.

Service fees. Cutz Mapz may charge service fees or transaction fees on certain payments processed through the platform. Any applicable fees will be disclosed to you before you complete a transaction.

Cutz Mapz provides a direct messaging feature that allows barbers and customers to communicate. Barbers may send deal cards — structured offers containing a service description and price — to customers through direct messages.

Deal offers are agreements between the barber and the customer. Cutz Mapz facilitates the communication and display of deal cards but is not a party to, and assumes no liability for, any arrangement, agreement, or transaction that results from deal messages. Both parties are responsible for honoring the terms of any deal they agree to.

Cutz Mapz provides a marketplace for barbers and shop owners to list and browse chair rental opportunities. Chair rental listings, negotiations, agreements, and payments are solely between the listing party and the renting party.

Cutz Mapz acts as a marketplace facilitator and is not a party to any chair rental agreement. We do not verify the accuracy of chair rental listings, guarantee availability, or assume any responsibility for disputes arising from chair rental arrangements.

Ownership. You retain ownership of any content you post on Cutz Mapz, including reviews, photos, profile information, portfolio images, and feed posts.

License grant. By posting content on the platform, you grant Cutz Mapz a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, modify, and distribute your content in connection with operating and promoting the platform. This license survives termination of your account for content that has already been shared publicly.

Content moderation. We reserve the right to remove, edit, or hide any content that violates these Terms, our platform rules, or applicable law. This includes but is not limited to reviews containing hate speech, false claims, personal attacks, or commercially misleading information.

The Cutz Mapz name, logo, brand identity, website design, source code, proprietary algorithms, and all related intellectual property are owned exclusively by Cutz Mapz and are protected by applicable copyright, trademark, and intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Cutz Mapz intellectual property without our prior written consent.

Your use of Cutz Mapz is also governed by our Privacy Policy, which describes how we collect, use, share, and protect your personal information. By using the platform, you consent to the data practices described in the Privacy Policy.

CUTZ MAPZ IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee the quality, safety, skill, or legality of barber services offered through the platform. We do not guarantee barber availability, appointment accuracy, or the completeness or accuracy of barber profiles, reviews, or pricing information. You use the platform and engage barber services at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CUTZ MAPZ, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY.

IN NO EVENT SHALL CUTZ MAPZ'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO CUTZ MAPZ IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Binding arbitration.Any dispute, claim, or controversy arising out of or relating to these Terms or the use of Cutz Mapz shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Los Angeles County, California, unless you and Cutz Mapz agree to a different location or virtual proceedings.

Class action waiver. You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration against Cutz Mapz.

Governing law. These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

We reserve the right to modify or update these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and may notify you via email or in-app notification for material changes.

Your continued use of Cutz Mapz after any changes to the Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the platform and close your account.

We may suspend, disable, or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, harmful behavior toward other users, or inactivity.

You may delete your account at any time through your account settings. Upon termination, your right to use the platform ceases immediately. Sections of these Terms that by their nature should survive termination — including but not limited to intellectual property, disclaimers, limitation of liability, dispute resolution, and indemnification — shall survive.

If you are a barber with an active subscription, termination of your account does not entitle you to a refund of any prepaid fees for the current billing period.
